Mr.Caron recently attended meetings with the
Department of Justice in Ottawa on behalf of the
National Real Property Section, to discuss with the Department certain items
that are of concern to treal estate practitioners on a national level.
Some of the items discussed included:
- "Criminal" rate of interest
- Section 347 of the Criminal Code of Canada makes it difficult for
lenders to enter into participation mortgages with borrowers;
- Section 222 of the Excise Tax Act
gives the Government a super-priority over secured lenders
- Interest Act of Canada - some
provisions are antiquated and are not of commercial benefit
- National Personal Property Registry -
